Sars guns for former Prasa CEO who owes over R1.8m in unpaid taxes
JOHANNESBURG – The South African Revenue Service (Sars) has obtained warrants of execution to seize the moveable assets of former Passenger Rail Agency of South Africa (Prasa) CEO Lucky Montana.
Montana confirmed this on Wednesday saying it was in connection with unpaid taxes of about R1.8 million. The debt related to the capital gains taxes he failed to pay when he bought two properties worth millions of rand.
The former Prasa boss was dismissed from the parastatal in 2015 following allegations of maladministration and corruption, which he denied.
Montana said the sheriff of the court ambushed him at his Saxonwold home on Wednesday with a warrant of execution. The taxman arrived to seize his moveable assets such as his cars and furniture, but nothing was taken away.
He admitted he owed Sars but claimed he was in negotiations to pay the tax agency by selling one of his properties.

Unlawful R420m Gupta VAT refund – Sars legal head fired with immediate effect
Revenue service Sars said on Friday it had terminated the services of its head of legal, Refiloe Mokoena, with immediate effect.
It said the decision was taken after a disciplinary hearing chaired by a senior counsel from the Johannesburg Bar.
Sars said Mokoena was found guilty of serious misconduct.
“Sars has accepted the chairperson’s recommendation of immediate dismissal and her services have been terminated with effect from today, November 15 2019,” Sars said.
BusinessLIVE reported in October that Mokoena, who was allegedly at the centre of granting the controversial Gupta family a reported R420m VAT refund, had been suspended.
It said Mokoena was asked by Sars in September to supply reasons why she should not be suspended by the tax agency over the Gupta refunds. Mokoena was one of five executives who were placed on precautionary suspension in recent months pending the conclusion of their disciplinary processes.

Chief of the revenue service, Edward Kieswetter said on Monday that South Africans could start withholding their tax payments due to years of corruption which might force the country to seek an international bailout.
Africa’s most industrialised economy has seen revenue collection fall sharply since 2015 due to weak economic growth and maladministration, leading President Cyril Ramaphosa to fire the revenue service boss last November in the wake of a judicial inquiry that has triggered an executive clean out.
New Revenue Service (Sars) commissioner Edward Kieswetter, hired in March, told a tax conference in Johannesburg that falling trust in the collector by individuals and companies had led to rising levels of tax avoidance and fraud, bleeding billions from government.
When public trust wanes, as is the current case, then taxpayers feel morally justified to withhold or manipulate their taxes,” Kieswetter said.

While National Treasury and SARS scramble for money, a new focus has been placed on the revenue service’s plans to tax SA expats working abroad , who could face having 45% of their earnings over R1 million fed back to government
South Africa’s expat tax is coming – and there’s only one way to legally avoid it.
Speaking on The Money Show this week, personal financial advisor at Galileo Capital, Warren Ingram said that even though the actual rules around the tax are yet to be finalised, they are planned to come into effect in March 2020.
The new legislation has many expats riled up, with much confusion and uncertainty around the new laws, and many believing that it will not apply to them or that it will be unenforceable.
It has also brought into question whether young South Africans who are working abroad for a short time are tax compliant.
According to Ingram, many South African expats who are working abroad are currently – unintentionally – flouting the country’s tax laws, and may already owe SARS money.
